The purchase of diesel fuel will warrant two point per gallon in lieu of one point per dollar spent. Gold Rewards Terms & Conditions Acknowledgment and Acceptance By enrolling and/or using the Gold Rewards program, you agree that you have read and understand this Agreement and that your participation in Gold Rewards shall conform to its terms and conditions. Gold Rewards is a loyalty program operated by Gas City ltd. Gold Rewards participants may earn points for enrolling in the program; taking advantage of Point-issuing opportunities, and complying with the terms of other offers or programs from Gold Rewards. Gold Rewards reserves the right to send participants mail, electronic or otherwise, for which they will not be rewarded. Gold Rewards is under no obligation to provide participants with a guaranteed number of Point-issuing or Point-Redeeming opportunities.
Gas City reserves the right to limit Gold Rewards enrollment at any time. Everyone is eligible to participate in Gold Rewards, but only individuals 18 years or older can win contests or prizes. A self addressed postcard to P.O. Box 554, Twin Falls, ID 83303-554 with participants card number will allow Gold Rewards participants entry into prize drawings. (No Purchase Necessary for entry) Points may be earned at any participating Gas City location for qualifying purchases (as specified by Gas City) using approved payment means. Instant prizes may be redeemed at any participating Gas City location, unless otherwise specified, so long as the item is available at the location. To be accepted by any participating Gas City location, the instant prize receipts must not be expired, illegible, altered or damaged. Duplicates of original receipts will not be accepted. Participant agrees to provide only true and accurate information to Gold Rewards and Gold Rewards, advertiser and partner offers, promotions, and programs at all times. Participant agrees to comply with the terms of all Gold Rewards and Gold Rewards advertiser and partner offers, promotions, and programs at all times. Participating organizations will not be eligible for prizes. Participant agrees not to abuse Gold Rewards privileges by conduct which is detrimental to the interests of Gas City and its Gold Rewards program, including without limitation attempting to accrue points or spend points in a manner inconsistent with the rules of Gold Rewards or intent of this agreement, attempting to earn points through other than legitimate channels, participating in purchasing or redemption fraud, or tampering with Gold Rewards award links, etc. Gas City reserves the rights terminate or disable, at Gas City’s sole discretion, any Gold Rewards participant account if Gas City believes such participant has violated or acted inconsistently with the rules of Gold Rewards or intent of this agreement. Participant understands and agrees that disabling of participant account will result in Participant's inability to redeem and/or earn points. Participant understands and agrees termination of participant account will result in the cancellation of all of Participant's points. Gas City shall be the sole determiner in cases of suspected abuse, fraud, or violation of its rules and any decisions it makes relating to termination of participant (including cancellation of points) shall be final and binding. Points have no cash or cash equivalent value. Points will be subtracted from Participant's account once the reward has been redeemed. Once redeemed, points will not be reinstated to Participant's account. Participant agrees to promptly notify Gold Rewards of any changes in participant's address (mail or e-mail). Participant's discontinued participation in Gold Rewards or failure to notify Gold Rewards of any address (mail or e-mail) changes my result in termination of Participant's account and forfeiture of Participant's unredeemed points. Unredeemed points will expire two years after last transaction date. In the event Gas City Ltd. ceases operations of Gold Rewards program all unredeemed points expire 90 days after the date of said ceasing of operations. Gas City Ltd. reserves the right to cancel or disable any participant account if that participant has been inactive for a period of 12 consecutive months. Inactive shall be defined as the lack of any point-issuing or point-spending activities. Gas City Ltd. reserves the right to limit the opportunities to earn points available to participant while participant remains inactive. Participant shall comply with all laws, rules, and regulations that are applicable to Participant. Participant acknowledges that Participant may only participate in Gold Rewards if and to the extent that such participation is permitted by such laws, rules, and regulations. Gas City Ltd., without liability to Participant or any other party, if Participant violates any law, rule, or regulation, or if Participant's participation in Gold Rewards, without liability to Participant or any other party, if Participant violates any law, rule, or regulation, or if Participant's participation in Gold Rewards could violate any law, rule, or regulation. Participants who win contests or promotions agree to allow Gas City Ltd. to use their name to promote the Gold Rewards program and/or said contests or promotions. Participants who win prizes given by Gas City Ltd. will be responsible for all taxes, titles and fees associated with the prize(s) . Disclaimer of Warranties Participant expressly agrees that use of Gold Rewards is at the Participant's sole risk. Gold Rewards and all services offered therein are provided on a strictly as is and as available basis. Gold Rewards Makes No Warranty With Regard to Any Products, Services or Rewards Obtained by Participants Through Gold Rewards or Through Gold Rewards Advertisers or Partners; That Gold Rewards Will Meet Participants' Requirements; or That Gold Rewards Will Be Uninterrupted, Timely, Error Free; Nor Does Gold Rewards Make Any Warranty as to The Results That May Be Obtained From The Use of Gold Rewards or as to The Accuracy or Reliability of Any Information Obtained Through Gold Rewards. Gold Rewards expressly disclaims any and all express and implied warranties, INCLUDING, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Gas City Ltd. shall not be liable or responsible for those guarantees, warranties and representations, if any, offered by Gold Rewards advertisers, partners, manufacturers of merchandise or suppliers of services. No advice or information, whether oral or written, obtained by Participant from Gas City Ltd. or through Gold Rewards shall create any warranty not expressly made herein. Limitation of Liability Gold Rewards Shall Not Be Liable For Any Damages, Whether Direct, Indirect, incidental, Special, or Consequential, Relating to The Participation or Inability to Participate in Gold Rewards. Some States Do Not Allow The Limitation or Exclusion of Liability For INCIDENTAL or Consequential Damages; So The Above Limitation or Exclusion May Not Apply to You. Gold Rewards is not responsible for damages or losses that result from participating or inability to participate in Gold Rewards, or reliance on or use of information, services, or merchandise provided on or through Gold Rewards. Participant acknowledges and agrees that Gold Rewards neither endorses the contents of advertisements or third parties' Web sites, nor assumes responsibility or liability for the accuracy of material contained therein, or any infringement of third party intellectual property rights arising there from, or any fraud or other crime facilitated thereby. Gas City Ltd. & its Gold Rewards program are not responsible and assume no liability for changes or discontinuances of service from providers which may affect offers or the accrual of Points. In no event shall Gas City’s liability, either jointly or severally, exceed $100. Participation in Promotions of Advertisers and Partners Participant's correspondence with or participation in promotions of Gold Rewards advertisers and partners are solely between corresponding Participant and the advertiser or partner. Gas City Ltd. assumes no liability, obligation, or responsibility for any part of any such correspondence or promotion, INCLUDING without limitation withdrawal or modification of any offer or promotion. Participant understands that, in some cases, there may be delay in the crediting of Points for promotions of advertisers or partners due to advertiser's or partner's failure to provide necessary information to Gold Rewards for such crediting of Points. Gas City Ltd. will not be responsible or liable for the delay or failure to credit Points in such event. Termination At Any Time Either Participant or Gas City Ltd. May Terminate Participant's Participation With or Without Cause. Participant's Right to Use Participant's Account Immediately Ceases Upon Termination And Participant's Unredeemed Points Shall Be Canceled. Termination of Participant's account by Participant is effective upon Participant submitting a termination request through the Gas City Ltd. web site. Participant understands that, in some cases, Participant may still receive messages (which may have been scheduled prior to Participant's termination) after termination. Participant may not earn Points after termination. Should Participant object to any of the terms and conditions of this Agreement, or any subsequent modifications thereto, or become dissatisfied with Gold Rewards, Participant's only recourse is to immediately discontinue participation in Gold Rewards and properly terminate his or her participation (See paragraph above.) Gas City Ltd. reserves the right to terminate the account of any Participant who appears to be using Gold Rewards in a manner inconsistent with this Agreement, the intent of this Agreement, or any Gold Rewards rules. Non-Transferability Participant's right to use Gold Rewards is nontransferable. Points are nontransferable and are void if transferred. Participant's account will terminate immediately in the event of Participant's death. Points and/or rewards may not be bartered or sold. Gold Rewards accounts and Points are not transferable upon death or as part of a domestic relations matter or otherwise by operation of law. Proprietary Rights to Content Participant acknowledges that Gold Rewards content (INCLUDING but not limited to text, sound, photographs, graphics, or other material contained in any Gold Rewards communication, advertisements, or messages, whether by Gas City or Gas City’s advertisers or partners), service and software are protected by copyrights, trademarks, service marks, patents, and/or other proprietary rights and laws; therefore, Participant is only permitted to use content, service, or software as expressly authorized by Gas City Ltd., its advertisers and partners, as the case may be. Modifications Gas City Ltd. reserves the right to change this Agreement, and/or any part thereof, at any time. Participant understands the most recent version of this Agreement will be located on the Gas City Web site under the Gold Rewards Terms of Service. Participant's non-termination or continued use of Gold Rewards constitutes an affirmative acknowledgment by Participant of any modification to the Participant Terms of Service Agreement and consent to abide and be bound by any terms thereof. At any time, if Participant does not agree with the Participant Terms of Service, Participant may terminate Participant's account. Gas City Ltd. reserves the right to modify or discontinue the Gold Rewards service with or without notice to Participant. Gas City Ltd. shall not be liable to Participant or any third party should Gas City Ltd. exercise its right to modify or discontinue the Gold Rewards service. Notices All notices given by Gold Rewards to you will be given by e-mail, regular mail or by general posting on the Gas City Web site. Indemnification Participant agrees to indemnify and hold Gas City Ltd., its affiliates, officers, and employees harmless from any claim, demand, expense, or damage, INCLUDING reasonable attorneys' fees relating to use of Gold Rewards or violation of this Agreement. Laws
Any dispute or claim arising out of or in relation to this Agreement, or the interpretation, making, performance, breach, or termination thereof, shall be finally settled by binding arbitration in Twin Falls, Idaho, under the Commercial Arbitration Rules of the American Arbitration Association by three arbitrators appointed in accordance with said Rules. Judgment on the award rendered by the arbitrators may be entered in any court having jurisdiction thereof. This contract shall be governed by the law of the State of Idaho, excluding its conflict of law principles. The arbitration proceedings shall be governed by federal arbitration law and by the Rules, without reference to state arbitration law. Participant and Gas City Ltd. agree that, any provision of applicable law notwithstanding, neither party will request, and the arbitrators shall have no authority to award, punitive or exemplary damages against the other party. This Agreement constitutes the complete and exclusive understanding between Gas City Ltd. and Participant relating to the subject matter hereof and supersedes all prior or contemporaneous understandings, agreements, communications, and/or advertising with respect to such subject matter. If any provision(s) of this Agreement is held by the arbitrators to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. Gas City’s failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Gas City Ltd. in writing. Privacy Statement Gas City Ltd., as the operator of the Gold Rewards program, is committed to protecting our customer’s privacy. Therefore, enrolling in the Gold Rewards program is completely voluntary and there for your benefit as a valued patron. We collect a limited amount of personal information in order to operate the program, process your rewards, and inform you of any prizes you have won. All information you provide is secured and properly safeguarded for your protection. In addition, your information is not sold or given out to anyone outside Gas City Ltd. or KickBack Rewards, our loyalty service provider.
